Meeting called to order by President, Ellen Keyes at 10:40 AM
Welcome and greeting.
Attendance: Block A homeowner’s 13 present - representing 10 HOA properties
Block B homeowner’s none present
Ellen commended the wonderful job the late Charlotte Bilder did as Association Treasurer. She also reminded everyone that Jim Bilder was our “association documents expert”, and expressed the importance of having a board member who is very familiar with those documents.
President’s Report: Ellen continues to receive correspondence regarding an Everglades Blvd. property that is facing foreclosure but is not a Beau Rivage Estates property. She also receives correspondence from various association management companies. She thanked John Cortazzo for repairing our community entry sign.
Ellen talked about heavy equipment that was parked on our community property when the neighboring road was being repaved. We maintain our private roads, and this type of heavy equipment can very probably cause damage. She encourages all residents to challenge strangers who are on community property to determine if they have a valid reason and the authority to be there.
Ellen stressed the need for board members.
Treasurer’s Report: Report was presented by Marge Nicastri.

Motion to accept this year’s budget as presented was made by John Cortazzo and seconded by Kay Balciulis. Acceptance was unanimous.
Association dues need to be paid no later than May 31, 2009, and will remain the same as last year.
Block A $250.00 dues and Road Fund $50.00 - $300.00 Total
Block B $250.00 dues - $250.00 Total
Architectural Committee members were chosen: John Cortazzo, John Webb, Johnnie Hughes, Jim Keyes, Ellen Keyes, and Sean Lavelle.
Nominations for board members were accepted and approved unanimously as presented: Jim Keyes, John Webb, Marge Nicastri, Faith Englund, Johnnie Hughes, Ellen Keyes, Lynne Webb, John Cortazzo, Sean Lavelle, and Brent Bomer (subject to his approval since he was not present).
New Business: Sean and Regina Lavelle raised the issue of drainage at the Cove View cul-de-sac, and expressed their concern that the condition is becoming worse. Discussion followed during which time Ellen Keyes informed everyone that she received a figure of approximately $3,750.00 in 2007 for a complete community swale survey. Several of those present, including Sean Lavelle and Jim Keyes agreed that the weir may be too high, and volunteered to change it. John Cortazzo voiced the opinion that virtually no Beau Rivage Estates properties have swales that are as they should be. Ellen implored everyone not to make repairs “piecemeal”. Jim Keyes suggested locating community “high spots” after heavy rainfall. Discussion turned to driveway swales, and property owner maintenance of those. The issue was raised as to whether the association needs or does not need three bids for any and all work projects paid for from Association funding.
Motion was made by Sean Lavelle to ask the Architectural Committee to meet with homeowner’s whose properties are impacted by drainage problems at the Cove View cul-de-sac location. The meeting date has yet to be determined, but is planned for 1:00PM on a Sunday prior to March 10, 2009, at the Lavelle home. Faith Englund seconded the motion, and all present voted in the affirmative. The Architectural Committee is to assess the situation and make recommendation to the Board for their review and final decision. All residents will be notified as soon as the meeting is scheduled.

The first meeting of the 2009 Board of Directors was held immediately to vote for Association Officers:

The Board members failed to provide a president from their group.
The Board of Director’s first order of business will be to select a new president and schedule the meeting with HOA property owners and the Architectural Committee.

The meeting was called to order by President, Ellen Keyes.
Copies of a community plot map were passed to all present. Ellen allowed all directors time to voice their opinions regarding swales and drainage. Glenn Perrone volunteered to contact both Martin and St. Lucie counties to see if they will address slow drainage along Britt Road, east of our community, and will report his findings to the board members.
Ellen inquired as to whether any of the directors have experience or knowledge regarding the topic of swales and drainage that may be helpful. Glenn Perrone and Jack Brackett informed the group that they are knowledgeable in engineering methods, and Jack announced that he is expert at operating heavy equipment.
Lon Singleton was present. Lon was able to get a St. Lucie County engineer to come to our community last spring to give advice regarding our swales and drainage. The engineer suggested we might contact the company that works on St. Lucie County swales:

After listening to all input Ellen concluded that there are five possible areas of concern:
· Behind Lot 15
· Front of Lot 14
· Street in front of Lot 12
· The weir
· Britt Road – two locations
It was decided that the first and most obvious problem location would be the first to address. Ellen Keyes and Glenn Perrone will approach the property owner within seven to ten days to engage his cooperation.
A volunteer “Drainage Committee” led by John Cortazzo was selected. These men will offer to help Association members correct swale defects. Members are:

Tom Beang reported on the possibility of our community obtaining municipal water from Martin County services. He explained that the first step would be for 51% of our Block A members to sign a petition requesting response from Martin County regarding this issue. He also spoke about costs and payments, which have yet to be determined. Tom initially began his research by contacting officials in our county of residence, St. Lucie. He will attempt to set up an appointment with St. Lucie County’s Barbara Guettler, to speak to us at the June meeting. She would inform us of just how this process will work, and answer any and all questions. John Webb suggested that all Block A members be notified about the municipal water issue. Faith Englund, who designed our community website was present, and suggested posting a notice on our Beau Rivage Estates website. All official notices for our community will be sent by U.S. mail as required by our by-laws.
Since the January 27, 2007 board meeting Ellen has consulted with an engineer regarding our swales. He informed her that it was impossible to make a precise determination without measurements, and without water being present. He suggested that our community culvert pipes be inspected to evaluate performance, and he commented that our “system looks pretty good”.
Swale and drainage discussion by members resulted in a vote that Ellen will approach Lot 15 home owner. She will present a letter from the board expressing their hope that he will consult a drainage professional to inspect his swales to determine if they are negatively impacting community drainage. Jim Bilder motioned, Paul Arnholt seconded, and all present board members voted in favor of this plan.
A committee was formed to review HOA by-laws. Ellen Keyes, Jim Bilder, and Colleen Cea will be working on that task.
Ellen feels Beau Rivage Estates needs to implement an emergency contact system.

Minutes from the April 26, 2007 Board of Directors Meeting were approved as read.
A copy of the letter that Board members agreed at the April 26 meeting should be sent to Raphael Fernandez was mailed on April 30, and another copy was hand delivered to him on April 30, 2007 by Ellen Keyes. Mr. Fernandez indicated at that time that he would be attending the May 24 meeting, but was not present as promised. Therefore the Board was unable to determine whether or not he had moved on their request to engage a drainage expert.
Ellen updated board members present regarding her meetings with the following drainage professionals:
Shenandoah Construction – Mindy Cotrupi. Ms. Cotrupi evaluated culvert pipes on the west border of lots 15, 10, 9, and 4, and the southwest border of lot 26. She mentioned “slip-lining” pipes to reinforce older metal culverts. Estimates are available for individual homeowners based on length and diameter of pipes. A vacuum truck is available at $145.00 per hour to clean culvert pipes located under driveways. Our entire community could be completed in one day. Re-grading the swale between lots 15, and 16 appears to be necessary. Recommended by Shenandoah for re-grading services:

Turpining & Culpepper – Bill Archebelle. Mr. Archebelle walked Association properties at the Cove View cul-de-sac. He also suggested re-grading the swale between lots 15 and 16, and behind lot 15. All swales should be evaluated before cleaning of culvert pipes.
All evaluations stressed a need for survey measurements to insure any maintenance of our Association drainage would be performed in a continual, consistent process resulting in a lot to lot effective flow of water to our pond. Piecemeal corrections might create additional problems.
Tom Beang summarized his communications with County officials regarding our homes connecting to the city water supply. He shared a letter he received responding to “specific” concerns. He would like the opportunity to approach individual Association
homeowners to explain the water connection process. We are scheduled to meet with a County official on June 21, 2007 at First Presbyterian Church at 7:00 PM for a question and answer session. All Association members will be notified by mail two weeks prior to the meeting. Homeowners not reached by Tom will also receive a copy of the “concerns” letter.
The Board discussed various approaches to correcting water flow at the northwest corner of Association property. There was not enough interest in contracting a survey to take a vote. The board did vote unanimously to send a certified letter to Mr. Fernandez with a copy to be sent to the Lavelles. The Board specified the letter should cover the following points:
The Board of Directors of Beau Rivage HOA respectfully request a re-grade of the swales at both the north and west border of your property by a licensed professional.
The re-grade should be accomplished within 30 days of receipt of this letter.
Please advise the Board as to how you plan to address this request.
Beau Rivage Estates HOA by-laws do allow the Board authority to proceed with the re-grade correction at your expense.
We are anxious to resolve this issue before heavy rains begin.
We find our Board is stalled over this issue without your cooperation.
